1. Agreement to Terms

Welcome to OnceUponBooks! These Terms of Service ("Terms") govern your access to and use of the OnceUponBooks website at onceuponbooks.com and our personalized storybook creation services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Service. Our Service is designed for adults to create personalized books for children.

2. Service Description

OnceUponBooks creates personalized children's storybooks featuring AI-generated illustrations based on photos you provide. Our Service includes:

• Selection of classic story templates with personalization options
• AI-powered transformation of uploaded photos into illustrated characters
• Digital storybook delivery via download link
• Optional physical book printing and shipping

5. Intellectual Property Rights

5.1 Our Content

The Service, including its original content (story templates, website design, logos, and software), is owned by OnceUponBooks and protected by copyright, trademark, and other laws. Our story templates are based on public domain works but include original adaptations and text.

5.2 Your Content

You retain ownership of all photos you upload. By uploading, you grant us a limited license to process, store, and transmit these photos solely to provide the Service.

5.3 Your Storybook

Your completed personalized storybook is licensed to you for personal, non-commercial use only. You may not resell, redistribute for profit, or commercially exploit the storybook content without our written permission.

6. Pricing and Payment

• All prices are displayed in USD and are subject to change without notice
• Applicable taxes and shipping fees will be calculated at checkout
• Payment is processed securely through Stripe
• You must provide accurate and complete payment information
• We reserve the right to refuse or cancel orders at our discretion

7. Delivery

7.1 Digital Delivery

Digital storybooks are typically delivered within 2 business days of order completion. You will receive an email with a download link when your book is ready.

Download window: Your digital storybook (including PDF and generated images) will remain available for download for up to 7 years from your order date. After that period, we may delete the files. We recommend downloading and saving a copy for your records.

Link confidentiality: Access to your digital storybook may be provided through a unique link that includes your order ID. Treat this link as confidential. Anyone with the link may be able to access the book, and you are responsible for any sharing of the link.

7.2 Physical Delivery

Physical books are premium 8" × 8" hardcover books with 30 full-color pages. Books ship within up to 14 business days. Delivery times vary by location. We are not responsible for delays caused by shipping carriers, customs, or incorrect shipping information provided by you.

Physical books may be fulfilled by third-party print-on-demand and shipping partners (for example, Gelato). To fulfill your order, you authorize us to share your shipping information with those partners.

7.3 Shipping Address

You are responsible for providing a correct and complete shipping address. We are not liable for books lost or delayed due to incorrect address information.

9. Prohibited Uses

You agree not to use our Service to:

• Upload photos of individuals without proper consent or legal authority
• Upload photos containing nudity, violence, or inappropriate content
• Create content that is defamatory, harassing, or harmful to others
• Violate any applicable laws or regulations
• Infringe on any third party's intellectual property rights
• Attempt to reverse engineer, hack, or exploit our systems
• Use automated systems (bots, scrapers) to access the Service
• Resell or commercially exploit the Service or generated content
• Impersonate others or provide false information

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, error-free, or secure
• That AI-generated content will meet your expectations
• That results will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCEUPONBOOKS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or use
• Any damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless OnceUponBooks and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including privacy or intellectual property rights; or (d) any content you upload to the Service.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where OnceUponBooks is established, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you may bring claims in small claims court if eligible. You waive any right to participate in class action lawsuits. This arbitration provision applies only to the extent permitted by law.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnity, and limitations of liability.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OnceUponBooks regarding the Service and supersede all prior agreements and understandings.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
